Admittedly, I’ve not read the Report and Recommendations, or anything giving Spain’s side of the issues, but Odyssey’s Objections seem pretty convincing–at the very least there are a number of factual disputes that should not be resolved without hearing evidence, such as whether it is even the ship Spain says it is (no signs of explosion/fire on any of the recovered artifacts, recovery site not within sight of land whereas a contemporaneous source said land was visible when she went down after exploding). It also sounds like there is good evidence that, even if that was the ship, she was carrying commercial cargoes for hire (another factual issue) and thus not entitled to sovereign immunity.
