Screw that toadie. All he did was complain that people were mean to him and he offered no substantive reason behind his stupid position on the Jones Act other than a nebulous “its expensive”. Somebody’s pulling his strings behind the scenes.
I am amazed that Workboat has not put out a statement that Max Blowhard’s opinion is his own, and that Workboat does not share his view. I am surprised that Workboat has not published a good article supporting the Jones Act.
Blowhard’s only arguments are obvious and shopworn. Obviously, it is cheaper to replace American workers with super low wage workers that have few rights. This is true whether we are speaking about mariner’s, longshoremen, truck drivers, airline pilots, construction workers, manufacturing workers, school teachers, nurses, doctors, engineers, accountants, lawyers, computer programmers, or whatever. That is without getting into environmental rules, taxes, foreign government subsidies, or any of the other things that make it much higher cost for a U.S. company to operate in the U.S. This is nothing new. Nor is the concept restricted to the Jones Act trade.
Workboat is a very small, low quality niche magazine (an obsolete media) that apparently does not even know that its market niche is the Jones Act trade. Workboat does very little “journalism.” It mostly just hosts cheap articles from correspondents that probably are not paid over $100 per article and are only Writing to promote themselves. Workboat mostly does puff pieces cheerleading for shipyards, gear manufacturers ( in other words, their advertising base) and boat operating companies about boats built or repaired. There is a little bit of incisive news and commentary, but not much.
Blowhard was half right about one thing. He called the opposition comments a “tempest in a teapot.”
Inconsequential Jones Act “tempest in a piss-pot” would be a more apt description of his articles.

I am just returning home after driving nearly 500miles today on a trip to Vancouver, WA and back. Needless to say that several hours ago I read Z-Drive’s post of Hardberger’s utterly selfserving response to my calling him out but was unable to post anything here before now. I am frankly too tired at the moment to say much other than to thank you for your photo and to everyone else who has taken a stand alongside myself with my clearly stated position against the man and his diatribe. What I hope everyone here who cares about this subject and wants to cram it down the good captain’s throat is to go to Hardberger’s screed at Workboat.com and tell him exactly what you think of him and his obtuse opinion of the Merchant Marine Act of 1920. Tomorrow morning after I get some sleep there will be a long and very detailed response from me to him there but I do not want to be alone in condemning the man for wanting to throw us all under a bus for nothing more than to create higher profits for businesses in Alaska, Hawaii and PR. The man is obviously shilling for their interests and more than willing to see each and every one of us American mariners crushed beneath their wheels as a result.
Time to get serious shipmates and bring up the 16" HE rounds to fire back at him! INCOMING!

Yes, “Fleet Admiral Bernstein” is a PHAT PHUCKING PHRACE in the same vein as my other “favorite” ridiculous cartoon “captain” who’s name need not be mentioned again here but this thread is not about Bernstein or that other great bloated media whore PHUGITIVE. It is about Max Hardberger and his unsupportable rant to give away OUR jobs to appease his masters. Hardberger is the one who needs our unanimous condemnation here today.

[B]Jones Act Challenge Fails[/B]

The U.S. Court of Appeals for the Ninth Circuit turned away a challenge to the Jones Act on July 30, 2015. The case, brought in Hawaii by certain shipper interests, argued that the Jones Act impaired interstate trade and therefore violated the United States Constitution.
The U.S. District Court in Hawaii had dismissed the case, concluding that the challengers lacked standing. The U.S. Court of Appeals affirmed that decision and, more importantly, concluded that the constitutional challenge would not have prevailed anyway. The appellate court concluded that whether the Jones Act is a “restraint of trade” is irrelevant because the Commerce Clause of the U.S. Constitution gave Congress broad authority to impose such a restraint.
The Court of Appeals also noted that there was no proof that shipping rates to Hawaii would decline even if the Jones Act were repealed, but it failed to note the potential impact on the transportation of merchandise between the U.S. mainland and Hawaii – in U.S. interstate commerce – of other U.S. domestic laws such as the Internal Revenue Code and Immigration and Nationality Act. It can be argued that even without the Jones Act, the costs of interstate ocean transportation would not be significantly different than it would be with the Jones Act in place.
The case is reminiscent of a case brought in Louisiana in 2012 against a private defendant seeking to enforce Jones Act citizenship requirements. That case, seeking a private remedy with respect to a public statute that does not provide a private remedy, was dismissed in October 2012.
