If my dumb ass friend decided that he wants to drive his center console boat back home under the influence, I’m on board, holding an MMC as Master….Am I now held responsible for any adverse outcomes? He tells me I am, purely by being a licensed professional. I think it’s bologna.
Make his drunk azz sign a waiver saying that you, under no circumstance have any control or command of that vessel under any circumstances. If he refuses, don’t ride on his center console & report him for a reward at first chance. If you 2 are buds, the friendship will last.
It’s more of a general scenario for anyone. I don’t really ride with him.
Sounds good, but isn’t. If he’s drunk he’s incapable of giving informed consent. The waiver is worthless. Thant you provided the waiver is evidence you knew of the risks and did not act. It probably makes things worse, not better.
What if he did it while sober? Say signed and notarized?
Find a new friend… Your situational awareness is missing many clues. So, maybe your dumb friend has a dumb friend?

This is actually a question I’ve had for a while (less the drunk friend). If you were hired on a vessel as mate while you hold a masters license and for whatever reason the captain is not onboard, can you be held responsible for whatever actions you do or do not take (since you are not hired as master)?

I doubt your azz is on the line here. picture the same situation with a airplane, train locomotive, long haul truck etc. AI could probably show some court cases where a precident has already been set?
I’ve heard this question asked many times but have never heard of a passenger being found guilty of crashing a boat they didn’t own or weren’t driving by the USCG or anyone else.
To me this is as dumb as saying that if you happened to have been a licensed Master as a passenger on the Costa Concordia then you too may have been at fault…no, just no.
