Jerome Bruce (“Bruce”) brought an action for negligenceseeking damages pursuant to the Jones Act for injuries he sustained whileemployed by RCS, LLC (“RCS”) as a supervisor to a tank cleaning crew.
Bruceallegedly sustained injuries to his ankle while boarding an RCS crewboat (“theVessel”), which was destined to travel offshore to perform tank cleaningservices for W & T Offshore Inc. (W & T).
RCS filed a Motion for Summary Judgment arguing Bruce has not met the requirements for seamen status, thus barring him from bringing an action for negligence under the Jones Act.
