Proprietary Information has nothing to do with it. Once you get to court you can subpoena any document or person you need to prove your story. The only thing you cannot get your hands on are the notes between anyone and their attorney. Restated no one has the right to keep anything away from a judge who wants to see it.

Oh really ! and are you naive enough to believe that the data subpoenaed would not have been massaged to cover their erroneous tracks ? How many roughnecks you know can afford a lawyer ? How many have the financial resources to take on a sustained battle in court against a giant like BP. How many lawyers might get bought over or face the risk of ruining their own careers and business firms. Rights ? We all know it is illegal to steal but that don’t mean if I dropped my wallet on the sidewalk no one’s going to pick it up.
