Shouldn't legal risk be treated the same a operational risk?

thread title is yes it should.
My question is does a captain make any decisions that are not paper based risk assessments, sure they do.
Some minor some have major implications. Thats where the legal issues come in.

The saying goes " A pound of prevention is worth an ounce of cure" meaning better to avoid problems altogether than to deal with the damage caused.

The issue is that the path which is 100% without legal issues may not exist and if it does it’s very narrow and getting narrower.
